If you are selling products to consumers in the European Union, new rules require you to designate a Responsible Person established within the EU. Without an EU Responsible Person, your products may not legally be placed on the EU market and you could face listing removals, customs blocks, or other disruptions.
Why a Responsible Person is Now Required
Under the EU General Product Safety Regulation (EU) 2023/988, products sold to EU consumers must have a responsible economic operator established in the EU. This responsible party is referred to as the Responsible Person (RP).
The RP must be clearly identified and must be available to provide market surveillance authorities with documentation proving the safety and compliance of the product. The RP ensures that your products meet EU safety standards, even if you are based outside the EU.
Without an EU Responsible Person, products are considered non-compliant and can be refused at customs, removed from platforms, or recalled from the market.
What is the Difference Between an Authorised Representative and a Responsible Person?
An Authorised Representative (AR) and a Responsible Person (RP) are related roles, but they are not automatically the same.
An Authorised Representative (AR) is an EU-based person or company formally appointed by a non-EU manufacturer through a written mandate, primarily for products subject to CE marking legislation. The AR performs specific regulatory tasks on behalf of the manufacturer, such as keeping the EU Declaration of Conformity and technical documentation available for authorities, cooperating with market surveillance authorities, and assisting with corrective actions where required. The AR's responsibilities are defined by the applicable EU harmonisation legislation (such as the Machinery Regulation, Radio Equipment Directive, EMC Directive, or Low Voltage Directive) and by the scope of the written mandate.
A Responsible Person is the EU-based economic operator identified for a product under the GPSR. The RP acts as the official contact point for EU market surveillance authorities, verifies that required compliance documentation and traceability information are available, and cooperates with authorities where a product safety issue arises.
The Responsible Person may be the EU manufacturer, importer, Authorised Representative, or, in certain cases, a fulfilment service provider. An Authorised Representative can fulfil the Responsible Person role when it has been properly appointed and the written mandate covers the relevant responsibilities.
Can an Authorised Representative Act as an EU Responsible Person?
Yes. An Authorised Representative can also act as the Responsible Person when the appointment and written mandate cover the applicable legal responsibilities.
