EU’s General Product Safety Regulation (GPSR): A New Standard for Consumer Protection

Starting December 13, 2024, the General Product Safety Regulation (GPSR) (EU) 2023/988 replaces the General Product Safety Directive, strengthening consumer protection across the EU. This regulation applies to all consumer products and even those originally intended for professional use if they later reach the consumer market.


The GPSR complements other EU product safety laws, addressing risks not covered by sector-specific regulations. It introduces significant changes for economic operators (EOs) and authorities to enhance product safety.


Key Changes Under the GPSR

Expanded Product Coverage: Now includes online sales, as well as new, used, repaired, and reconditioned products. Some exemptions apply, such as medicinal products, food, transport equipment, and antiques.

Stronger Risk Assessments: Businesses must conduct more detailed safety evaluations throughout a product’s lifecycle.

Greater Accountability: A responsible EU-based economic operator (manufacturer, importer, authorized representative, or fulfillment service provider) must ensure compliance.

Enhanced Market Surveillance: Authorities have increased powers to inspect products and remove unsafe items from the market. RAPEX is now called Safety Gate, improving the exchange of information on dangerous non-food products.

Consumer Protection & Cybersecurity: Consumers have better access to safety information and reporting tools. New cybersecurity and AI-related safeguards help prevent product risks.


Unlike the previous directive, the GPSR applies directly across all EU Member States, making compliance a legal requirement.
